1 / 7.Valid IDMake sure you always keep a valid copy of the ID of the hired employee in your own personnel administration.

2 / 7.Trusted agencyMake sure that the employment agency from which you hire people is NEN 4400-1 affiliated. Only then do you have the guarantee that the bureau pays the social premiums correctly and you as the hiring company will not get problems with ‘chain liability’ (which means you remain at all times responsible for the payment of the premiums for the hired employee).

3 / 7.Employment statement and an E101 statementIf you hire personnel from Bulgaria or Romania, via a foreign partner, remember that the hired personnel need both an employment statement and an E101 statement. Romanians and Bulgarians may do contract work in the Netherlands without the employment ruling as they then work under the services guideline (though this may never be work via a temporary employment agency).

4 / 7.Certified flex home seal of approvalIf you want to be certain that your foreign temps have good accommodation, check if the employment agency is affiliated to the ABU.

5 / 7.Medical insuranceCheck the medical insurance of your foreign temps. If they are from other European countries, they must be insured in accordance with the Dutch Medical Insurance Act.

6 / 7.26 weeks according to the CAOA temp can (only) be paid for 26 weeks according to the CAO of the temporary employment branch. The employment agency is then legally obliged to observe the payment regulation of the company of its principal. In most cases the salary in this case is much higher.

7 / 7.Contract for a specified timeYou may offer an employee a contract for a specified time three times with a maximum duration of 3 years (this ruling applies even if you first allow the employee to work via the employment agency).
